Ignition Interlocks Now Required for Some Louisiana DUI/DWI Offenders
There is a new law in effect requiring first-time DUI/DWI offenders in New Orleans to install an ignition interlock device in their vehicles. The Louisiana law is applicable to DUI/DWI offenders with no previous record who want to apply for a hardship license and continue driving after an arrest.
Generally a DUI/DWI arrest in New Orleans means an automatic 90-day license suspension, with an opportunity to petition for a hardship license after 30 days. The installation of an ignition interlock device as a condition of the hardship license would require that the following conditions be met:
- The driver guilty of the DUI/DWI offense must pay for all related expenses, including rental and installation fees, as well as costs associated with testing and calibration
- The New Orleans driver may operate his or her vehicle only during specified time periods and between approved destinations
- The driver must display a blood alcohol content less than 0.3 percent before ignition of the vehicle can occur
- The equipment records must be sent directly to the Louisiana Department of Motor Vehicles and to the DUI/DWI case probation officer
The ignition interlock can be removed only after the DUI/DWI sentence has been completed and all probation terms met.
