Penalties for Louisiana DUI/DWI

According to Louisiana, including New Orleans, DUI/DWI law, a drunk driving conviction can mean more than a suspended license.  In addition to the 12-month revocation of driving privileges, first time DUI/DWI offenders can expect the following penalties:

  • Monetary fines of up to $1,000 in addition to the cost of litigation
  • Up to six months in prison
  • An increase in annual auto insurance premiums
  • A permanent criminal record that could impact future employment opportunities
  • Loss of Drivers License for 1 year.

Penalties for DUI/DWI convictions increase with each subsequent offense and are frequently updated by state legislature.  For this reason, it is important to work with a DUI/DWI attorney who is well acquainted with current New Orleans DUI/DWI law.

Drivers license suspension for DUI/DWI

New Orleans DUI/DWI law request that a driver stopped on suspicion of DUI/DWI must submit to a chemical test involving breath, blood, or urine to determine the presence and level of an illegal substance in the body.  In addition to alcohol, such substances can include over-the-counter, prescription, or illicit drugs.  Extreme sleep deprivation or driver fatigue can also be the cause of a DUI arrest.

Drivers arrested on a DUI/DWI charge in Louisiana are faced with both a criminal and a civil DUI/DWI charge that determines the extent of the penalties associated with the crime.  Those first-time offenders convicted of a DUI/DWI or those who refused to submit to a chemical test at the time of arrest are subject to a six-month license suspension.

Within 15 Days of the Arrest

According to Louisiana DUI / DWI law, however, the offender has the right to challenge a license suspension by requesting an administrative hearing through the Louisiana Department of Motor Vehicles within 15 days of the arrest.
