Louisiana Workers Compensation

Mental or physical injuries caused by an accident occurring within the course and scope of your employment may entitle you to workers compensation benefits. Medical coverage and financial reimbursement are available to qualified employees and their families who suffer from a debilitating or disabling workplace injury.

What Should I Do?

If you have been involved in an accident at work in Louisiana, be sure to seek immediate medical attention and inform your supervisor as soon as possible. Injuries must be reported within 30 days to ensure eligibility for Louisiana workers compensation benefits.

Once reported, your employer will notify both his or her insurance company and the Office of Workers Compensation Administration (OWCA). In determining whether your injury or illness is compensable, your employer may arrange for a separate and independent medical examination at the company's expense.

If your injury is deemed compensable, you may be entitled to both medical coverage and financial compensation for any lost wages. In addition, eligible dependents may receive workers compensation benefits or secondary education scholarships when the injured party is permanently disabled or killed in a work-related incident.

When Can I Expect Payment?

Your first benefit check should arrive within two weeks from the day you notify your employer. This check includes compensation beginning on the eighth day after your injury. If, however, you are out of work for more than 42 days, you may receive benefits for the first seven days. Compensation for permanent disability maybe determined upon your ability to return to work or after recovery.

When Must I File?

A formal claim must be filed with the OWCA within one year from the date of injury if you have not collected benefits. You may have one or three years from the date of the last payment, respectively, to file a claim depending on your situation.
